GENERAL TERMS AND CONDITIONS
1. scope of application
These General Terms and Conditions (hereinafter referred to as GTC) govern the relationship between L'Atelier de Beauté (hereinafter referred to as "L'Atelier de Beauté") and customers (hereinafter referred to as "Customer").
2 Cosmetic service
L'Atelier de Beauté provides non- and minimally-invasive cosmetic treatments as a service. As far as required by law, the treatments are carried out under the supervision of a medical specialist, The duration of treatment depends on the agreements of the individual case. The treatment time starts at the agreed time. An extension of the booked treatment is spontaneously possible only if other appointments are not affected.
2.1 Making appointments for cosmetic services
Registrations for appointments are binding. If the customer is not able to keep an appointment, we ask you to cancel at least 48 hours in advance by phone or in writing (letter or email). Over the weekend within 72 hours. If the cancellation is late or not in time, the booked treatment or at least CHF 100 will be charged. This also applies to free consultations. The chosen beautician is not binding and can be replaced by another one.
2.2 Invoicing and terms of payment for cosmetic services
Invoices for treatments must be paid within 30 days of the invoice date. If the fees are not paid in due time, interest on arrears and further costs may be incurred. Outstanding debts and debt collection may be passed on to third parties.
3. medical service
L'Atelier de Beauté provides private medical services in the field of aesthetic dermatology as well as plastic surgery.
These GTC and the medical information on the homepage are not a substitute for consultation and / or treatment by doctors.
3.1 Appointment for medical services
The treatment is based on the agreements of the individual case. The treatment time begins at the agreed time. An extension of the booked treatment is spontaneously possible only if other appointments are not affected.
Registrations for treatments are binding. If the client is unable to attend a treatment appointment, please cancel at least 48 hours in advance by phone or in writing (letter or email). Over the weekend within 72 hours. If the cancellation is late or not in time, the booked treatment or at least CHF 100 will be charged. This also applies to free consultations. In case of a confirmation for surgery, a booking fee of CHF 500 is due immediately. Surgery appointments will only be confirmed after receipt of the booking fee. The surgery fee will be credited to the cost of the surgery and cannot be refunded, transferred or offset against other services.
For scheduled surgery appointments, a cancellation free of charge is only possible if it is made at least 7 calendar days in advance in writing (letter or email) by the customer. In case of cancellations less than 7 days before the surgery, the full cost of the surgery is to be paid. The chosen doctor is not binding and can be replaced by another one.
3.2 Invoicing and payment terms for medical services
Invoices for treatments must be paid within 10 days of the date of the invoice. For operations, advance payment is agreed. If fees are not paid on time, interest on arrears and other costs may be incurred. Outstanding debts and debt collection may be passed on to third parties (for release from professional secrecy, see section 10 of these General Terms and Conditions).
The Patient agrees that the attending physician may provide the data required for invoicing and collection to L'Atelier de Beauté, based in Zurich (c/o Fundus Treuhand AG, Badenerstrasse 567, 8048 Zurich).
3.3 Financing conditions for medical services
The following conditions apply to installment payments.

- No hidden costs
- Up to 48 monthly installments possible
In case of an installment payment you automatically agree to the terms and conditions.
MF Group AG acts as a settlement company and may, if necessary, transfer the receivables transferred to it to its financing partner in Germany for the purpose of settlement and enforcement. MF Group AG and its financing partner are subject to the relevant provisions of Swiss, respectively German and European data protection law and process patient data with the utmost care and absolute confidentiality under their own responsibility.
In the case of payment by installments, we require your consent for this billing procedure:
You hereby agree to the transfer of the personal data and other information required in each case for the purpose of credit assessment, settlement (including assignment of the claim) and assertion of the claim, in particular data from the patient file (name, date of birth, address, date of treatment) to MF Group AG. The following data may be transmitted to the financing partner in Germany for processing under its own responsibility: Name, address, date of birth, invoice amount and internal identification features, e.g. customer ID). If the claim has to be enforced in court if necessary, your physician will also disclose the subject of treatment to MF Group AG and its financing partner upon request of MF Group AG.
You hereby release your physician from his/her medical confidentiality obligation to the extent necessary for credit assessment, billing (including assignment(s) of the claim) and assertion of the claim.
Your consent also applies to future treatments; you may revoke it at any time with immediate effect for the future.
You hereby confirm that you are capable of acting and are at least 18 years old.
4. terms of sale (online store)
The general terms and conditions of the online store at: www.latelierdebeaute.ch apply to orders of products deviating.
5. liability
Liability in the context of cosmetic treatments
The customer has to notify us in writing of obvious treatment defects within 3 calendar days after he could recognize the defect. Otherwise, warranty rights are excluded. Further warranties and guarantees, including in relation to compatibility and success of treatment methods and products used, are not given.
The liability of L'Atelier de Beauté and its agents is limited to gross negligence and intentional acts. The above limitations of liability do not apply in the case of culpable injury to life, limb and health, and for the quality of the product and fraudulently concealed defects. In the event of a breach of material contractual obligations, any claims for damages shall be limited to typical and foreseeable damages. The liability according to the product liability law remains unaffected.
Claims for damages against L'Atelier de Beauté expire three months after the contractual termination of the treatment, unless the claims are asserted within this period.
L'Atelier de Beauté cannot be held liable for damages caused by wrong information and/or omission of essential information by the customer.
Liability in the context of surgical treatments
All treatments and operations at L'Atelier de Beauté are carried out according to the state of knowledge of medical science and research. Despite careful execution of the activities, no guarantees can be given for success, especially not for the aesthetic or plastic result. The doctor's instructions must be strictly followed. This also includes pre- and post-treatment. Otherwise, any claim for corrections or after-treatments expires. L'Atelier de Beauté reserves the right not to treat the customer in case of refusal.
In the case of in-patient medical services provided by L'Atelier de Beauté, the out-patient and in-patient services provided by an external in-patient medical facility, which go beyond the medical services provided by L'Atelier de Beauté, are subject to a separate legal relationship with the customer. L'Atelier de Beauté is not responsible and not directly liable to the clients in case of any breach of duty with regard to these services of the affiliated medical facility.
6. treatment of minors
L'Atelier de Beauté does not perform medical and surgical treatments on underage persons.
7. vouchers
Vouchers can only be used to pay for treatments offered at the time of redemption and during opening hours.
Our offered vouchers for treatments are valid according to their defined term. The voucher must be redeemed within the voucher validity period. No extension is possible after this period. The vouchers expire no later than 12 months after their issue unless otherwise stated.
The cash payment, including residual amounts, should the voucher value exceed the amount to be paid or an exchange of the vouchers in goods vouchers in the online store are not possible.
The vouchers are personal and non-transferable. In case of loss or theft the voucher will not be replaced.
8. subscriptions
Subscriptions can only be used for the specified services / treatments. Offsetting with other services / treatments is not possible. Subscriptions are personal and cannot be transferred. Subscriptions expire no later than 18 months after issue. Refund of paid subscriptions is not possible.
9. data protection
Your personal data will be treated confidentially and will be used and processed exclusively within the framework of the applicable data protection laws.
The customer agrees that his personal data may be used for advertising for own and third party purposes (e.g. delivery of a customer newsletter and participation in own competitions). The customer can prohibit the processing of personal data at any time without giving reasons and revoke the given consent for the future.
10. release from the medical professional secret
In order to carry out the treatments and operations, L'Atelier de Beauté is dependent on processing health information of the customers, which may be subject to professional secrecy (Art. 321 StGB). The customer expressly releases the doctors as well as employees of L'Atelier de Beauté, insofar as they are subject to professional secrecy, from professional secrecy with regard to all information and documents which the customer makes available to L'Atelier de Beauté.
The customer agrees that
- L'Atelier de Beauté will forward data required for invoicing and collection to (name/address of billing agency) or to its collection partner (name/address of collection partner of billing agency), as the case may be,
- in the event of a persistent delay in payment, can provide the debt collection office with the information required for debt collection, and
- L'Atelier de Beauté can provide the competent court with the necessary information for the enforcement of the fee claim.
11. after-treatments for hyaluron and muscle relaxant
After-treatments for hyaluron and muscle relaxant are possible within 14 weekdays (not working days) free of charge. From the 15th weekday until and including the 30th weekday after the treatment, a 50% discount can be given on the official treatment price. A post-treatment after the 30 weekday is to be charged in full.
The "muscle relaxant" consumption per region must be respected. An additional charge of CHF 5 per unit must be made for "muscle relaxant" consumption of 10 units or more.
The hyaluron consumption per region must be adhered to. From an excess consumption of 0.5 ml, an additional charge of CHF 125 per unit must be made.
12. self-pay services
All services of L'Atelier de Beauté are excluded from cost sharing by health insurance companies. All services are self-pay services.
13 Final provisions, jurisdiction and applicable law
Should any provision be or become invalid, this shall not affect the validity of all other provisions or agreements.
The court in Zurich is responsible for disputes. Swiss law shall apply.
These GTC are valid from 01.04.2023.
